Unsolicited Idea Submission Policy


V.I.P. First Class ® or any of its employees do not accept or consider unsolicited ideas, including ideas for new advertising campaigns, new promotions, new or improved products or technologies, product enhancements, processes, materials, marketing plans or new product names. Please do not submit any unsolicited ideas, original creative artwork, suggestions or other works (“submissions”) in any form to V.I.P. First Class ® or any of its employees. The sole purpose of this policy is to avoid potential misunderstandings or disputes when V.I.P. First Class ®’s products or marketing strategies might seem similar to ideas submitted to V.I.P. First Class ®. If, despite our request that you not send us your ideas, you still submit them, then regardless of what your letter says, the following terms shall apply to your submissions.

Terms of Idea Submission
You agree that: (1) your submissions and their contents will automatically become the property of V.I.P. First Class ®, without any compensation to you; (2) V.I.P. First Class ® may use or redistribute the submissions and their contents for any purpose and in any way; (3) there is no obligation for V.I.P. First Class ® to review the submission; and (4) there is no obligation to keep any submissions confidential.


Product Feedback
V.I.P. First Class ® does, however, welcome your feedback regarding many areas of V.I.P. First Class ®’s existing business. If you want to send us your feedback, and we hope you do, we simply request that you send it to us using the form found at www.vipfirstclass.com/concierge/?contact , or you can choose from the many other listed areas for your feedback. Please provide only specific feedback on V.I.P. First Class ®’s existing products or marketing strategies; do not include any ideas that V.I.P. First Class ®’s policy will not permit it to accept or consider. It’s just one more way that V.I.P. First Class ® can learn how to best satisfy your needs.

V.I.P. First Class ® Trademark


V.I.P. First Class ® is a trademark of V.I.P. First Class registered with the United States Patent and Trademark Office and other countries. When using the marks in publications that will be distributed only in the United States, include the appropriate ™, ℠, or ® symbol on first use. For publications that will be distributed outside the United States, do not include trademark symbols. Instead use the appropriate trademark attribution notice, for example: V.I.P. First Class ® is a trademark of V.I.P. First Class ®, registered in the U.S. and other countries. For all publications, include an appropriate generic term after the trademark the first time it appears. Thereafter, the generic term should appear frequently with the trademark. (These generic terms are only suggestions, and there may be other words that are equally appropriate.) Trademarks are adjectives, and should not be made into verbs or made plural or possessive. Guidelines for Using V.I.P. First Class ® Trademarks and Copyrights


These guidelines are for V.I.P. First Class ® licensees, authorized resellers, developers, customers, and other parties wishing to use V.I.P. First Class ®’s trademarks, service marks or images in promotional, advertising, instructional, or reference materials, or on their web sites, products, labels, or packaging. Use of the V.I.P. First Class ® Logo for commercial purposes without the prior written consent of V.I.P. First Class ® may constitute trademark infringement and unfair competition in violation of federal and state laws. Use of V.I.P. First Class ® trademarks may be prohibited, unless expressly authorized.

If you are a licensee of an V.I.P. First Class ® trademark or logo and have been provided with special trademark usage guidelines with your license agreement, please follow those guidelines. If your license agreement does not provide usage guidelines, then follow these guidelines.

V.I.P. First Class ®’s trademarks, service marks, trade names, and trade dress are valuable assets. In following these guidelines, you help us protect our valuable trademark rights and strengthen our corporate and brand identities. By using an V.I.P. First Class ® trademark, in whole or in part, you are acknowledging that V.I.P. First Class ® is the sole owner of the trademark and promising that you will not interfere with V.I.P. First Class ®’s rights in the trademark, including challenging V.I.P. First Class ®’s use, registration of, or application to register such trademark, alone or in combination with other words, anywhere in the world, and that you will not harm, misuse, or bring into disrepute any V.I.P. First Class ® trademark. The goodwill derived from using any part of an V.I.P. First Class ® trademark exclusively inures to the benefit of and belongs to V.I.P. First Class ®. Except for the limited right to use as expressly permitted under these Guidelines, no other rights of any kind are granted hereunder, by implication or otherwise. If you have any questions regarding these guidelines, please submit your query to V.I.P. First Class ®’s Trademark Department.

 

Authorized Use of V.I.P. First Class ® Trademarks

1. Advertising, Promotional, and Sales Materials: Only V.I.P. First Class ® and its authorized resellers and licensees may use the V.I.P. First Class ® Logo in advertising, promotional, and sales materials. Such authorized parties may use the V.I.P. First Class ® Logo only as specified in their agreement with V.I.P. First Class ® and any associated Guidelines and such use must always be in conjunction with the appropriate terms that define the relationship authorized by their contract with V.I.P. First Class ®.

2. Publications, Seminars, and Conferences: You may use an V.I.P. First Class ® word mark in connection with book titles, magazines, periodicals, seminars, or conferences provided you comply with the following requirements:

a. The use is referential and less prominent than the rest of the title.

b. The use reflects favorably on both V.I.P. First Class ® and V.I.P. First Class ® products or services.

c. Your name and logo appear more prominent than the V.I.P. First Class ® word mark on all printed materials related to the publication, seminar or conference.

d. The V.I.P. First Class ® logo or any other V.I.P. First Class ®-owned graphic symbol, logo, icon or image does not appear on or in the publication or on any materials related to the publication, seminar, or conference without express written permission from V.I.P. First Class ®.

e. A disclaimer of sponsorship, affiliation, or endorsement by V.I.P. First Class ®, similar to the following, is included on the publication and on all related printed materials: “(Title) is an independent (publication) and has not been authorized, sponsored, or otherwise approved by V.I.P. First Class ®.”

f. A trademark attribution notice is included in the credit section giving notice of V.I.P. First Class ®’s ownership of its trademark(s). Please refer to the section below titled “Proper Trademark Notice and Attribution.”

3. Web Sites: Web sites that serve only as noncommercial electronic informational forums concerning an V.I.P. First Class ® product or service may use the appropriate V.I.P. First Class ® word mark, provided such use complies with the guidelines set forth in Section 2 above.

 

Unauthorized Use of V.I.P. First Class ® Trademarks

1. Company, Product, or Service Name: You may not use or register, in whole or in part, V.I.P. First Class ®, or any other V.I.P. First Class ® trademark, including V.I.P. First Class ®-owned graphic symbols, logos, icons, or an alteration thereof, as or as part of a company name, trade name, product name, or service name except as specifically noted in these guidelines.

2. V.I.P. First Class ® Logo and V.I.P. First Class ®-owned Graphic Symbols: You may not use the V.I.P. First Class ® Logo or any other V.I.P. First Class ®-owned graphic symbol, logo, or icon on or in connection with web sites, products, packaging, manuals, promotional/advertising materials, or for any other purpose except pursuant to an express written trademark license from V.I.P. First Class ®, such as a reseller agreement.

3. Variations, Takeoffs or Abbreviations: You may not use a similar image or other variation of the V.I.P. First Class ® logo for any purpose. Third parties cannot use a variation, phonetic equivalent, foreign language equivalent, takeoff, or abbreviation of an V.I.P. First Class ® trademark for any purpose. For example:

4. Disparaging Manner: You may not use an V.I.P. First Class ® trademark or any other V.I.P. First Class ®-owned graphic symbol, logo, or icon in a disparaging manner.

5. Endorsement or Sponsorship: You may not use V.I.P. First Class ®, or any other V.I.P. First Class ® trademark, including V.I.P. First Class ®-owned graphic symbols/logos, or icons, in a manner that would imply V.I.P. First Class ®’s affiliation with or endorsement, sponsorship, or support of a third party product or service.

6. Merchandise Items: You may not manufacture, sell or give-away merchandise items, such as T-shirts and mugs, bearing V.I.P. First Class ®, or any other V.I.P. First Class ® trademark, including symbols, logos, or icons, except pursuant to an express written trademark license from V.I.P. First Class ®.

7. V.I.P. First Class ®’s Trade Dress: You may not imitate the distinctive V.I.P. First Class ® packaging, web site design, logos, or typefaces.

8. Slogans and Taglines: You may not use or imitate an V.I.P. First Class ® slogan or tagline.

For example: “World Elite Exclusive”, or "A World of Possibilities".

9. Domain Names: You may not use an identical or virtually identical V.I.P. First Class ® trademark as a second level domain name.

Not acceptable:    “vipfirstclassparties.com”     “vipfirstclasschina.com”     “etc-vipfirstclass.com”     “vipfirstclassmart.com”

 

Rules for Proper Use of V.I.P. First Class ® Trademarks

1. Trademarks are adjectives used to modify nouns; the noun is the generic name of a product or service.

2. As adjectives, trademarks may not be used in the plural or possessive form.

3. An appropriate generic term must appear after the trademark the first time it appears in a printed piece, and as often as is reasonable after that.

4. Always spell and capitalize V.I.P. First Class ®’s trademarks exactly as they are shown in the V.I.P. First Class ® Trademark. Do not shorten or abbreviate V.I.P. First Class ® product names. Do not make up names that contain V.I.P. First Class ® trademarks.

 

Proper Trademark Notice and Attribution

1. Distribution Within the United States Only

a. On product, product documentation, or other product communications that will be distributed only in the United States, use the appropriate trademark symbol (TM, SM, ®) the first time the V.I.P. First Class ® trademark appears in the text of the advertisement, brochure, or other material.

b. Refer to the V.I.P. First Class ® Trademark List for the correct trademark symbol, spelling of the trademark, and generic term to use with the trademark. Generally, the symbol appears at the right shoulder of the trademark (except the V.I.P. First Class ® Logo, where the logo appears at the right foot).

c. Include an attribution of V.I.P. First Class ®’s ownership of its trademarks within the credit notice section of your product, product documentation, or other product communication.

Following are the correct formats:

2. Distribution Outside the United States:

a. Do not use trademark symbols on products, product documentation, or other product communications that will be distributed outside the United States.

Depictions of V.I.P. First Class ® Products and Services

1. Endorsement or Sponsorship: V.I.P. First Class ® does not support the use of its logos, company names, product names, or images of V.I.P. First Class ® products by other parties in marketing, promotional or advertising materials as their use may create the perception that V.I.P. First Class ® endorses or sponsors the product, service or promotion.
